Welcome to royalsubic.com (the “Site”), which is part of Royal Duty Free Shops, Inc. (also referred to as “Royal”, “We”).  These Terms of Use shall govern your access and use of this Site, including the mobile versions or mobile applications made available, if any.   By accessing the Site and/or using the services, you confirm that you have read, understood and accepted these Terms of Use and agree to be bound by them.

We may, at our sole discretion, update or modify these Terms of Use from time to time, without prior notice. Any modifications to these Terms of Use will become effective when published on the Site.  Your continued use of the Site after the changes constitutes your agreement to be bound by the most recent amended version of these Terms of Use.

These Terms of Use also apply to all orders placed using other media, including email, telephone or facsimile.

Registration

You will need to register an account to use some of the services available to you on the Site. In registering an account, you agree to provide information about yourself that is true, accurate, current, and complete in all respects. You must also keep your information up-to-date by informing us of any changes by using the relevant sections of the Site. You may refer to our Privacy Policy for more information on how we use your personal data.

You are solely responsible for safeguarding your username and password to access the services of this Site and for any activities or actions under your password. You shall be liable for every order made under your account and as such, agrees to indemnify Royal for all liabilities, claims, damages whatsoever arising from the actions of any person placing orders through this Site using your account. You should notify us immediately if you have knowledge that or have reason for suspecting that the confidentiality of your account has been compromised or if there has been any unauthorized use thereof.

Only persons who are at least 18 years old may create an account on our Site. If you are a minor, seek the assistance and supervision of your parent or legal guardian when accessing or using our Site.

Suspension Or Termination Of Account

You expressly agree not to use the Site for any purpose or in any matter that is unlawful or infringes on any third-party intellectual property rights.  We reserve the right to immediately, and without prior notice, suspend or terminate your account, cancel your orders, prohibit you from accessing or using our website, and from sending purchase orders, if we suspect that:

  1. Your account was used or involved in any in any fraudulent or unlawful activity;
  2. Any of the information that you provided to us is false, inaccurate, incomplete, or outdated;
  3. Your account was used for any purpose detrimental to the business of Royal;
  4. You violated any of the provisions of these Terms of Use; or
  5. Your continued access to or use of our Site poses a threat to the privacy or security of our Site or the accounts of other customers.

Products

Product information and content displayed on the Site are for reference only and may vary at the time of actual transaction.  Royal makes reasonable efforts to provide accurate and updated content, image and description on the Site but all such product information is subject to change without prior notice, at our sole discretion.

We endeavor to display as accurately as possible the colors and images of our products in the Site as it appears at the store.  However, color you see in the Site will differ with the actual color as this depends on the display features of the device you are using.

Royal reserves the right to limit the sales of our products or services to any person, geographic location or jurisdiction; limit the quantities of any products or services that we offer; and discontinue any product at any time.

Pricing

Prices in the Site are in Philippine Peso for local items and US Dollar for imported items. Royal makes reasonable efforts to provide accurate and up-to-date pricing and promotional information but Royal reserves the right to vary the price and other pricing and promotional details without prior notice.

The price to be paid at checkout shall be based on the prevailing selling price at the time we receive your order, which may or may not be the same at the Site at any time thereafter due to price changes, conversion of foreign currency price to Philippine Peso in the case of imported products, and the like.

The prices indicated at the Site are for on-line shopping only. The prices of the product in the Site may be different from that sold in the physical store.

Placing An Order Through Personal Shopper Service

You may place your order through our Personal Shopper Service. We may also require verification of information prior to the acceptance and/or shipment of any order.  Royal reserves the right to decline or cancel any order at any time, at our sole discretion. If you have already paid for your order before it was cancelled, we will refund your payment to you upon showing of proof of your payment.

Orders are processed on a first-come, first-served basis. Our system automatically updates the information on available stocks. However, there may be instances when there will be a delay or error in performing the said update. We will notify you if you happen to place an order for a product that is already out of stock and will cancel your order.  Royal reserves the right (but undertakes no duty) to offer alternative or substitute products with similar price value and range for which you may place a new order. The same applies to information about the price of the products. If we discover any error in the price of any of the products that you ordered, we will notify you and will cancel your order.  You then have the option to place a new order based on the correct price.

Discount items, free gifts, promotional items and the like are subject to stock availability. No substitution and no prior notice will be made if stocks are not available.

We shall not be liable for any and all liabilities, claims, costs, expenses, damages, and losses arising from, or related to, our cancellation of your order due to any of the above mentioned causes.

Payment And Vouchers

Payments of the orders shall be made in Philippine Peso.  The following payment methods are acceptable:

  1. Credit and Debit Cards
  2. Prepaid Transactions using different platforms

During payment processing, you will be redirected to another website owned and operated by an independent payment gateway service provider, which shall collect and process your financial information pursuant to its own terms and policies. You shall be solely responsible for providing accurate, complete and updated information to enable the service provider to process your payment method. You further represent and warrant that the use of your chosen payment method is authorized and legal and that you have sufficient value in your card or prepaid transaction to cover your bill for the goods you ordered.

While Royal will take reasonable care to keep secure your chosen payment method, Royal is a mere intermediary or facilitator of said payment schemes.  As such, the processing of your payment is a transaction between you, the payment gateway service provider and your issuing bank or entity from which you purchased your pre-paid value.  Royal shall not be held liable for any claim, loss, expense or damage that you may suffer as a result of a third party gaining unauthorized access or using for fraudulent purposes your chosen payment method.

Royal will issue a sales invoice to you via email upon approval of your credit or debit card transactions.

At any given time, promotional vouchers, in the form of a code, may be made available for use in the Site. By using the promotional voucher, you understand and agree to be bound by its terms and conditions.

Delivery

The following delivery options are available:

Delivery

We will notify you once your order is ready for delivery.  Royal will exert reasonable efforts to deliver orders to the address you specified in the Site or last on record.  You shall be responsible for immediately notifying Royal of any change to your delivery address.

Orders shall be delivered to the entrance of your delivery address only and we are not obliged to deliver to a specific location within your premises or building. You shall ensure that deliveries are promptly received upon arrival of our delivery personnel.

You must designate a representative if you will not be available to receive your order. We reserve the right to request you or your representative to present a government-issued ID prior to the release of the products that you ordered.  You shall receive the delivery by signing off with your signature and a record of the delivery date.

If you or your authorized representative is not present to accept delivery; or there is an error in your specified delivery address; or we cannot access your delivery site, we reserve the right to withdraw delivery and charge extra fee in case of re-delivery.  In any case, Royal shall not be liable for any delays, change of delivery time/place or non-delivery for causes beyond its control or through no fault of its own.

Applicable delivery fees will be indicated upon checkout.  Royal may provide free delivery on all orders above a certain amount from time to time or as stated at Checkout and promotions.

Store Pick-Up

Your orders will be picked up in our physical store based on the schedule you indicated during checkout, which schedule shall be within our official business hours.  An email will be sent to you once your order is available for pickup.  Royal shall use reasonable efforts to prepare products for pick-up on your indicated schedule but reserves the right to modify the pick-up schedule at its sole discretion. Royal shall not be liable for any delays, change in pick up time or non-pick up for causes beyond its control or through no fault of its own.

The order should be picked-up by you or your authorized representative by presenting the sales invoice we sent you via email and a valid government-issued ID upon request.  You shall pick up the order by signing off with your signature and a record of the pick-up date.

Upon delivery or pick-up, you shall inspect the products before receiving them. Your acceptance of the products indicates that the same are in good condition, free from any defect and damage, and are the products that you ordered.

All risk in the products shall pass to you upon delivery or pick-up but Royal shall retain title in the products until full payment.

Returns And Exchanges Policy

Return and exchange of products are subject to the following:

  1. All defective merchandise for replacement or exchange must be returned within seven (7) days from the date of purchase, along with the sales invoice email that shall be issued together with the delivered item.
  2. Non-food merchandise must be returned complete with original packaging, manual, and factory sales intact.
  3. Undergarments and other opened or used personal items are not returnable nor exchangeable.
  4. Items considered as "Service Center" are not refundable and will be returned to an authorized Service Center to repair under manufacturer's warranty.
  5. Replacement or exchange of fresh items is only valid within 24 hours from date of purchase.
  6. Food items to be returned should at least be 75% intact.

Cancellation Policy

All orders are automatically processed on our system and sent for shipment as soon as they are placed. During this process we incur irreversible fees. Royal reserves the right to decline or cancel any order at any time, at our sole discretion. If you have already paid for your order before it was cancelled, we will refund your payment to you upon showing of proof of your payment. Therefore, while we understand that orders might need to be changed sometimes, we are unable to do it free of charge after a certain point. We strictly adhere to the following cancellation policy:

  1. If you cancel your order BEFORE it has been shipped, you will be assessed a 15% cancellation fee before credit is issued.
  2. If you cancel your order AFTER it has been shipped, please follow our Return Policies & Procedures. The cancellation will have to be treated as a Return with all applicable fees.
  3. Orders which are REFUSED AT DELIVERY will be assessed all of the applicable fees listed above - including restocking, cancellation and other applicable fees.

If a customer requests for a cancellation, the customer may reach and send a message at “Contact Us” on this site. Please note that Customer Care uses the same process shown above, so we can't guarantee that we can cancel your order.

Intellectual Property Rights

All intellectual property rights and content available in our website, including but not limited to, text, graphics, images, icons, designs, business, brand or trade names, domain name, logos, marks, copyrights, software and source codes as well as confidential information, business or trade secrets, know-how and database (collectively, the “Intellectual Property”) are exclusively owned by Royal or by third party owners that gave their permission for their use in our website.  You are prohibited from downloading, storing, uploading, posting, transmitting, using, distributing, copying, reproducing, selling, licensing, modifying, publishing, adapting, editing, creating any derivative works, or manipulating in any way the abovementioned intellectual property and content or any part of the Site for any purpose, without our express and prior written consent; except that you are given consent to view, make an electronic and or hard copy portions of the content for the sole purpose of placing an order and for non-commercial and personal use only.

All right, title and interest in the Intellectual Property in this Site are protected by copyright, trademark and other intellectual property rights and shall at all times remain the property of Royal and/or third-party owners.

Force Majeur

No party shall be liable to any breach of performance under these Terms of Use by reason of any delay in performing or any failure to perform any obligations if such delay or failure is due to any event or cause beyond reasonable control (each an event of "Force Majeure"). Without prejudice to the foregoing, the following events shall be regarded as events of Force Majeure:

  1. Act of God, natural disaster, explosion, flood, tempest, fire or accident;
  2. War or threat of war, sabotage, insurrection, civil disturbance or requisition, act of terrorism or civil unrest;
  3. Any law, order, acts, restrictions, regulations, prohibitions or measures of any kind on the part of any national or local governmental authority;
  4. Import or export regulations or embargoes or delays in transit;
  5. Interruption of traffic, strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Royal or of a third party);
  6. Health epidemics declared by the national and/or local government authorities and/or supranational bodies such as the World Health Organization;
  7. Interruption of production or operation, unavailability, shortages or difficulties in obtaining raw materials, products, labor, fuel parts or machinery;
  8. Power failure or breakdown in machinery; and
  9. Other causes similar to the foregoing.

Royal shall perform its obligations under these Terms of Use with reasonable skill and care.

Governing Law

These Terms of Use and your use of the Site (and all non-contractual relationships arising out of or connected to it or them) shall be governed by and construed in accordance with Philippine laws. You submit to the exclusive jurisdiction of Philippine courts to settle any dispute which may arise under these Terms of Use.
